TERMS AND CONDITIONS
GENERAL TERMS AND CONDITIONS OF THE E-SHOP
1. INTRODUCTORY PROVISIONS
1.1 These General Terms and Conditions (hereinafter the “Terms”) govern the mutual rights and obligations of OK PRODUCTS s.r.o., Company ID No.: 14382831, VAT ID: CZ14382831, with its registered office at Příkop 843/4, Brno – Zábrdovice, 60200, Czech Republic (hereinafter the “Operator” or “Seller”), and a natural person acting outside the scope of their business activity (hereinafter the “Consumer” or “Buyer”), arising in connection with or based on a purchase agreement (hereinafter the “Purchase Agreement”) concluded through the Operator’s online store.
1.2 These Terms are issued in accordance with:
- Directive 2011/83/EU on consumer rights,
- Directive (EU) 2019/770 on certain aspects concerning contracts for the supply of digital content and digital services,
- Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), and
- applicable laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.
1.3 By placing an order, the Buyer confirms that they have read and agree to these Terms.
2. DEFINITIONS
For the purposes of these Terms:
2.1 “E-shop” means the online interface available at www.okproducts.cz.
2.2 “Purchase Agreement” means a contract concluded between the Seller and the Buyer via the E-shop.
2.3 “Goods” means tangible movable items offered for sale through the E-shop.
2.4 “Digital Content” means data produced and supplied in digital form.
2.5 “Consumer” means a natural person acting outside their trade, business, or profession.
2.6 “User” means any person using the E-shop.
3. CONCLUSION OF THE PURCHASE AGREEMENT
3.1 The presentation of Goods on the E-shop constitutes an invitation to treat and shall not be considered a binding offer.
3.2 The Buyer places an order by completing and submitting the order form via the E-shop.
3.3 The Purchase Agreement is concluded at the moment when the Seller confirms acceptance of the order by electronic means.
3.4 The Seller reserves the right to refuse or cancel an order, in particular in cases of:
- manifest pricing errors,
- unavailability of Goods,
- suspected fraudulent activity.
4. PRICE AND PAYMENT TERMS
4.1 All prices are stated in EUR or CZK and include value added tax (VAT), unless otherwise specified.
4.2 The Buyer shall bear any costs associated with the selected payment method.
4.3 The total price, including delivery costs, shall be displayed before the order is submitted.
4.4 The Buyer is obliged to pay the purchase price in full prior to dispatch of the Goods, unless otherwise agreed.
5. DELIVERY TERMS
5.1 The Seller shall deliver the Goods via a carrier selected by the Buyer.
5.2 The estimated delivery time is 2 to 10 business days, unless otherwise specified.
5.3 The risk of damage or loss of the Goods passes to the Buyer upon delivery.
5.4 Delivery costs shall be specified prior to order confirmation.
6. RIGHT OF WITHDRAWAL
6.1 The Consumer has the right to withdraw from the Purchase Agreement within fourteen (14) days without giving any reason.
6.2 The withdrawal period shall expire fourteen (14) days after the day on which the Consumer acquires physical possession of the Goods.
6.3 To exercise the right of withdrawal, the Consumer must inform the Seller by means of a clear statement.
6.4 The Consumer shall bear the direct cost of returning the Goods.
6.5 The Seller shall reimburse all payments received without undue delay, and in any event not later than fourteen (14) days from the day on which the Seller is informed of the withdrawal.
6.6 The right of withdrawal shall not apply in cases specified under Article 16 of Directive 2011/83/EU, including but not limited to:
- Goods made to the Consumer’s specifications,
- perishable Goods,
- sealed Goods which are not suitable for return for health or hygiene reasons once unsealed,
- digital content supplied with prior express consent.
7. DEFECTIVE PERFORMANCE AND WARRANTY
7.1 The Consumer is entitled to exercise rights arising from defective performance within twenty-four (24) months from receipt of the Goods.
7.2 In the event of a defect, the Consumer shall be entitled to:
- repair of the Goods,
- replacement of the Goods,
- a reasonable reduction in price, or
- withdrawal from the Purchase Agreement.
7.3 The Seller shall handle complaints without undue delay, and no later than thirty (30) days from the date of submission.
8. USER ACCOUNT
8.1 The User may create a user account via registration.
8.2 The User is obliged to maintain confidentiality of login credentials.
8.3 The Operator shall not be liable for any damage arising from unauthorized access caused by the User.
9. DATA PROTECTION (GDPR)
9.1 The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR).
9.2 The following personal data may be processed:
- identification data (name, surname),
- contact details (email, phone),
- billing and delivery address,
- payment information.
9.3 The purposes of processing are:
- performance of the Purchase Agreement,
- compliance with legal obligations,
- legitimate interests of the Seller.
9.4 The legal basis for processing is:
- Article 6(1)(b) GDPR (performance of a contract),
- Article 6(1)(c) GDPR (legal obligation).
9.5 Personal data shall be retained for the period required by applicable law, typically up to ten (10) years.
9.6 The Consumer has the following rights:
- right of access (Art. 15 GDPR),
- right to rectification (Art. 16 GDPR),
- right to erasure (Art. 17 GDPR),
- right to restriction of processing (Art. 18 GDPR),
- right to data portability (Art. 20 GDPR),
- right to object (Art. 21 GDPR).
9.7 The Consumer has the right to lodge a complaint with the supervisory authority, namely the Office for Personal Data Protection of the Czech Republic.
10. ALTERNATIVE DISPUTE RESOLUTION
10.1 The Consumer may submit a complaint to the Czech Trade Inspection Authority (www.coi.cz).
10.2 The Consumer may also use the EU online dispute resolution platform available at:
https://ec.europa.eu/consumers/odr
11. WEEE (ELECTRICAL EQUIPMENT TAKE-BACK)
11.1 The Consumer is entitled to return end-of-life electrical equipment free of charge at:
Příkop 843/4, Brno, Czech Republic.
12. GOVERNING LAW
12.1 These Terms and the Purchase Agreement shall be governed by the laws of the Czech Republic.
12.2 Any disputes shall be resolved by the competent courts of the Czech Republic, unless mandatory EU consumer protection provisions provide otherwise.
13. FINAL PROVISIONS
13.1 The Seller reserves the right to amend these Terms.
13.2 Any amendments shall be published on the E-shop and shall become effective upon publication.
13.3 If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
14. EFFECTIVENESS
14.1 These Terms and Conditions shall enter into force on 25 March 2026.
